Copyright Free in 2009? Yeah Right!!!

 I just got this question on facebook from one of my students:

 

hey Cam - do you know/have you heard anything about there being no copyright attached to anything posted to the web as at 01/01/09 for US sites ? a photographer at work made mention of it  I forgot to mention it to you
My response was this:
 
I haven't but I cant see it being correct for a number of reasons, first being that if someones copyrighted work is put on the web without permission, the rights haven't been transferred legally to the uploader. Secondly if it was true in the US that wouldn't make it legal in Australia where we would still respect the rights of the original copyright holder. I can also see there being a number of other reasons why its not true, namely that there hasn't been a MASSIVE uproar from the traditional media such as the newspapers who wouldn't give over copyright willingly.

You have to be careful with copyright as a lot of the advice online is US or UK based and doesn't stand up in our (Australia's)legal system. Creative Commons is becoming more popular and there will be quite a bit of stuff released under this license over time.
